Are illegal immigrants eligible for workers’ compensation in Ohio?

Written by on Tuesday, September 22, 2015 at 5:44pm

Roofer-ImageIn the state of Ohio, illegal immigrants who are hurt on the job can still be compensated for their injuries. We know it can feel risky or even scary to contact an attorney for fear of deportation, but if you’re injured, you deserve full compensation.

Bentoff & Duber has no legal obligation to contact the Immigration and Naturalization Service (INS) about its illegal immigrant clients, so there is no concern there. However, even if INS finds out and deports you, you will still receive your awarded workers’ compensation benefits in your country of origin.

When you are injured at work, it’s especially important to reach out to an attorney, even if you are an illegal immigrant, because attorneys know the ins and outs of workers’ compensation laws. More than just getting your medical expenses paid and compensation for time spent off work, an attorney can also walk you through the claims to be sure you’re getting all the benefits you’re entitled to and compensated at the maximum rate you’re eligible to receive.

Lastly, the most important thing to remember if you are an illegal immigrant who was injured on the job is not to get intimidated. Your employer may try to scare you or tell you that you are not entitled to workers’ compensation benefits, but you are. We are here to support you.

If you have any questions for our workers’ compensation attorneys, or for a free consultation, call Bentoff & Duber at 216-861-1234 or submit a contact form.
