What do you do when you’re injured on the job?

Sep 26, 2013 |

Depending on your occupation, there are all kinds of ways you can accidentally be injured at work. If this happens, here are a few considerations to ensure you get the best treatment and everything you’re entitled to from your workers’ compensation claim. In addition to these general tips, you’ll also want to consider teaming with a workers’ compensation lawyer like the experienced Bentoff & Duber team. We have the knowledge of the law and we can ensure that you have the tools to maximize your claim.

  • File a written notice of injury with your employer immediately.
The best way to document an injury is to immediately notify your supervisor, HR department or boss to let them know you were injured and how it happened. Be sure to make a written statement with your job, and keep a copy of that statement for your own records.
  • Seek medical attention.
If you are injured, seek immediate medical attention. Make sure to tell the doctor that your injury occurred at work and accurately tell them how the injury happened. Save copies of your medical records, paperwork and treatments. Be sure to not miss any appointments.
  • Call a workers’ compensation attorney to determine the next steps.
An attorney can help you file a claim, submit medical bills, compensate you for being off of work, and help you get other benefits you deserve for being injured. Having an attorney is important, as they can answer any questions you may and guide you through the complex workers’ compensation system.
  • Keep track of all records.
In the event that your employer files your workers’ comp claim, ask for a copy of the paperwork. Hold onto all other evidence and written communication between you, your doctor, your employer and the workers’ compensation office.
  • Continue to ask questions and seek assistance throughout the process when you are injured at work.
If your employer tells you your injury is not covered or attempts to settle your case without you going through the system, they are likely pulling a fast one on you. Double check with a lawyer as to what benefits you are entitled.

These and many other things need to be taken into consideration in your workers’ compensation claim to make sure you are getting all of the benefits you are entitled to when injured on the job.
